Treason

Treason is the only crime explicitly defined in the U.S. Constitution, found in Article III, Section 3. It reflects the founders’ intent to narrowly define the offense to prevent its misuse for political purposes.

Federal law further codifies treason under 18 U.S.C. § 2381, which identifies two main types:

  1. Levying war against the United States: This includes organizing or participating in armed uprisings or acts of rebellion against federal authority.
  2. Adhering to enemies, giving them aid and comfort: This encompasses acts of loyalty, support, or assistance to foreign enemies of the United States during times of war.

The evidentiary standard for treason is stringent. Conviction requires testimony from two witnesses to the same overt act or a confession in open court.

Federal Treason Penalties

Penalties for federal treason are among the harshest in U.S. law. A conviction can result in death or life imprisonment. Additionally, individuals convicted of treason face fines and the loss of certain civil rights, including voting and holding public office.

From a legal defense attorney’s perspective, defending against treason charges involves a robust strategy to challenge the prosecution’s evidence. Common defenses include:

  • Lack of intent: Demonstrating that the accused did not act with the intent to betray the United States.
  • Insufficient evidence: Arguing that the prosecution lacks the required testimony of two witnesses or credible proof of an overt act.
  • Duress: Showing that the accused acted under immediate threat or coercion.
  • Misinterpretation of actions: Highlighting that the alleged conduct does not meet the legal definition of treason.

Treason in California

Treason is a rare but serious crime in California, defined under Penal Code § 37. It involves acts of betrayal against the state or government. California law recognizes two primary types of treason:

  1. Levying war against the state: This includes armed uprisings or violent attempts to overthrow the government.
  2. Adhering to enemies, giving them aid and comfort: This entails assisting a foreign or domestic enemy against California or the United States.

Convictions for treason require direct evidence and the testimony of at least two witnesses to the same overt act, or a confession in open court. This strict evidentiary standard reflects the crime’s gravity and its potential misuse for political purposes.

Penalties for treason in California are severe. If convicted, an individual may face life imprisonment without the possibility of parole or, in extreme cases, execution. Additionally, convicted individuals may lose their civil rights, including the right to vote or hold public office.

Given the rarity and gravity of treason charges, defense attorneys must scrutinize every aspect of the case, ensuring that constitutional safeguards protect the accused from wrongful conviction. The complexity of such cases demands meticulous preparation and unwavering advocacy of federal criminal defense attorney Nate Crowley.
